The court sentenced two defendants to fixed-term imprisonment and fined hundreds of thousands of yuan for the crime of infringing citizens’ personal information.
In June this year, the People’s Court of Luoping County, Yunnan Province also announced a case of using the "dark net" to infringe citizens’ personal information. The defendant posted on overseas websites, indicating the service items and prices of citizens’ personal information such as personal household registration, family household registration, house opening records, and living together records, and traded in bitcoin in the "dark net" market. From April to November 2018, more than 1,000 pieces of personal information of many people were illegally obtained and sold, with a profit of 1.33315 bitcoin, and 1.30948 bitcoin was converted into RMB 41,397.35.
The verdict shows that after the defendant claimed that he was deceived in finding a job, he came up with the idea of "making money by providing personal information online". Most of the information he sells is sent to the other party through Chinese forum network and dark goods trading market, and some of it is sent to the other party through social software. The information mainly includes personnel tracks, room opening records, mobile phone account opening information, etc. Among them, the highest price is mobile phone positioning information, and the lowest is household registration information.
In addition, obscene and violent videos in dark networks are also common. A case decided by the People’s Court of Pingyi County, Shandong Province shows that the defendant learned, downloaded and exchanged obscene and violent video files through the "dark net" and spread them to three people for profit.
According to a network technology practitioner, due to the anonymity of access, the encryption of information and the concealment of servers, the "dark network" soon became a new channel for criminals to engage in illegal and criminal activities after 2004. In addition to illegal trade in prohibited goods, illegal information such as pornography, kidnapping, assassination and terrorism is also extremely rich, and it has even become an important platform for terrorist organizations.
The "dark net" is not illegal.

Relevant government departments should organize domestic key cyber security research institutes to carry out research on special projects, so as to have the "dark network" management and control technical ability to meet the needs of cyberspace governance in China as soon as possible.
