Measures for the administration of special funds for intellectual property rights in Guangzhou High-tech Zone, Guangzhou Development Zone Chapter I
General Provisions Article 1 In order to fully implement the spirit of the Opinions on Strengthening Intellectual Property Protection, these Measures are formulated in accordance with the Reply of the State Council on Agreeing to Carry out the Comprehensive Reform Experiment of Intellectual Property Application and Protection in Sino-Singapore Guangzhou Knowledge City (Guo Han [2016] No.122) and the requirements of relevant provincial and municipal documents, combined with the actual situation of our region. Article 2 Enterprises, institutions, social organizations, other organizations or individuals that meet one of the following conditions within Huangpu District of Guangzhou, Guangzhou Development Zone and its entrusted management and subordinate parks (hereinafter referred to as the District) may apply for special funds for intellectual property support or assistance: (1)The place of registration, the relationship between tax collection and management, and the statistical relationship are enterprises that normally carry out R&D, production and business activities, have a sound financial system, have independent legal personality, and carry out independent accounting; (2) Intellectual property service institutions established in this area; (3) Incubators established in this area and determined by the competent departments of science and technology and intellectual property at all levels; (4) A social organization registered in this district, with the purpose of promoting the development of intellectual property, and the competent intellectual property department and copyright department of the district as the competent business units; (five) other relevant organizations established in this area; (six) the household registration personnel in this area or individuals who have worked in this area and purchased social insurance for more than one year in a row may apply for the relevant subsidies in Article 16 of these Measures. The application and authorization of a patent and the application and registration of a trademark shall be based on the place of production or business operation and the habitual residence in this district. If there are multiple applicants or obligees, the first applicant or obligee shall comply with the above provisions. Article 3 The special funds for intellectual property rights are mainly used to promote the comprehensive, coordinated and sustainable development of the creation, application, protection, management and service of intellectual property rights in this area, and to promote the implementation of the intellectual property strategy. chapter two
Creation and Protection of Intellectual Property Rights Article 4 Scope and standard of patent grant: (1) If domestic (including Hong Kong, Macao and Taiwan) invention patents are authorized, the maximum grant is 9,000 yuan/piece. (2) For those who apply for a patent to enter the national stage (abroad) through PCT, the maximum subsidy is 20,000 yuan/piece. (3)Grant 40,000 yuan/piece to those who are authorized by the invention patents of the United States, Japan, Britain, the European Union and South Korea; To obtain the authorization of invention patents from other countries (regions), the subsidy is 20,000 yuan/piece. Each patent grants authorization from up to 5 countries (regions). (four) for domestic (including Hong Kong, Macao and Taiwan) invention patents that are in the state of patent right maintenance at the time of application, if they are maintained for the sixth year from the date of application, the subsidy will be 1,800 yuan/piece, and if they are maintained for more than the eighth year, the subsidy will be 4,800 yuan/piece; If China National Intellectual Property Administration’s fee is reduced at the time of patent application, and it lasts for the sixth year or more, it will only subsidize 700 yuan/piece and 2800 yuan/piece respectively. Each invention patent can only apply for annual fee subsidy once. Those who have been authorized by the United States, Japan, Britain, the European Union, and South Korea for a new generation of invention patents in the information technology, artificial intelligence, and biomedical industries will be given annual fees for the first six years, and each year will be funded according to 50% of the actual expenses incurred in the previous year. Each patent subsidizes the annual fees of up to 3 countries (regions). Article 5 Encourage enterprises to cultivate high-value patent portfolios: (1) Grant 500,000 yuan to enterprises that meet the following conditions at the same time: 1. Have more than one core basic patent, which has won the China Patent Award or the Guangdong Patent Award (if innovative drugs or medical device products related to biomedical core basic patents have obtained the approval document for clinical trials or the drug registration certificate or the third-class medical device registration certificate, they will be deemed to meet these conditions); 2. Around the above-mentioned core basic patents,Apply for not less than 20 invention patents and not less than 10 PCT patents in the last year (if the patent portfolio is biomedical patents, the invention patents can be relaxed to not less than 10); 3. Form a high-value patent portfolio analysis report, and make multi-dimensional analysis on the generated high-value patent portfolio in terms of technical value, economic value and legal value, and fully expound and demonstrate the key links such as cultivation system, process, achievements and effectiveness. (2) The enterprise that meets the following conditions at the same time will be funded by 1 million yuan: 1. It has more than one core basic patent, which has won the China Patent Award or the Guangdong Patent Award (if the innovative medicine or medical device product related to the biomedical core basic patent has obtained the approval document of drug clinical trial or the drug registration certificate or the third-class medical device registration certificate, it will be regarded as meeting this condition), and it is in an effective state; 2. Around the above-mentioned core basic patents, no less than 60 invention patents and no less than 40 PCT patents were applied for last year (if the patent portfolio is biomedical patents, the invention patents can be relaxed to no less than 40); 3. Form a high-value patent portfolio analysis report, and make multi-dimensional analysis on the generated high-value patent portfolio in terms of technical value, economic value and legal value, and fully expound and demonstrate the key links such as cultivation system, process, achievements and effectiveness. (3) Grant 2 million yuan to enterprises that meet the following conditions at the same time: 1. Have more than one core basic patent, which has won the China Patent Award or the Guangdong Patent Award.(If the innovative drugs or medical device products related to the core basic patent of biomedicine have obtained the approval document of drug clinical trial or the drug registration certificate or the third class medical device registration certificate, they shall be deemed to meet this condition) and are in an effective state; 2. Around the above-mentioned core basic patents, no less than 120 invention patents and no less than 80 PCT patents were applied last year (if the patent portfolio is biomedical patents, the invention patents can be relaxed to no less than 80); 3. Form a high-value patent portfolio analysis report, and make multi-dimensional analysis on the generated high-value patent portfolio in terms of technical value, economic value and legal value, and fully expound and demonstrate the key links such as cultivation system, process, achievements and effectiveness. Article 6 Scope and standard of trademark assistance: (1) Where a trademark registration certificate is obtained through the Madrid system and registered by each designated country, each country (region) is approved to register and provide assistance to 1000 yuan. The same applicant can sponsor up to 5 trademarks each year, and each trademark can sponsor up to 20 countries (regions) for approval and registration. (two) to obtain the trademark registration certificate of the European Union Intellectual Property Office and the African Intellectual Property Organization (OAPI), the subsidy is 8,000 yuan/piece. The same applicant can support up to 5 pieces each year. (three) to obtain a foreign trademark registration certificate in a single country, the subsidy is 2000 yuan/piece. The same applicant can support up to 5 pieces each year. (four) in Hong Kong, Macao and Taiwan to obtain a trademark registration certificate, funded by 2000 yuan/piece. The same applicant can support up to 5 pieces each year. (5)Those who have obtained the registration certificate of domestic certification trademarks and collective trademarks will receive a subsidy of 200,000 yuan/piece. Article 7 Scope and standard of geographical indication funding: (1) A one-time support of 500,000 yuan will be given to agricultural products that have been protected by geographical indications or whose trademarks or collective trademarks have been successfully registered. (two) for enterprises to obtain the right to use the special signs of geographical indication protection products, give a one-time support of 200 thousand yuan; Those who have obtained the license to use geographical indication trademarks will be given a one-time support of 50 thousand yuan. Article 8 Scope and standard of copyright subsidy: Those who apply for copyright registration to the competent copyright authority will be subsidized to 300 yuan after obtaining the copyright registration certificate of computer software. Article 9 The scope and standard of funding for the registration of integrated circuit layout-design: those who apply for the registration of integrated circuit layout-design to the national intellectual property authority will be funded by 3,000 yuan/piece after being announced. Article 10 Support intellectual property rights that have won designated awards or reached specific conditions: (1) Those who have won national, provincial and municipal patent awards and trademark awards shall be given supporting support according to the standards of 100% at the national level, 70% at the provincial level and 50% at the municipal level. Intellectual property agencies that write award-winning patents will be supported according to 10% of the amount of support in this area. (two) well-known trademarks protected by China National Intellectual Property Administration, giving a one-time support of 1 million yuan. (3) A one-time support of 50,000 yuan will be given to those newly included in the protection list of key trademarks in Guangdong Province.Chapter III Intellectual Property Management Article 11 Management and funding standards for enterprises with intellectual property advantages in the district: (1) Enterprises that meet the following conditions at the same time may apply to the competent intellectual property department of the district, and be determined as enterprises with intellectual property advantages in the district after being selected on the basis of merit and submitted to the district government and management committee for approval. Under the same conditions, Give priority to enterprises that have passed the national intellectual property standardization management certification: 1. Have specialized intellectual property management institutions and full-time staff, establish a relatively complete intellectual property management and protection system, and have a certain proportion of special funds for intellectual property for patent application, maintenance, protection, training and reward; 2. Establish a patent retrieval system for scientific and technological development. The main R&D personnel can skillfully use the patent information system to access and analyze patent documents, and have the ability to conduct intellectual property evaluation or operation; 3. There are not less than 10 patents in the state of patent right maintenance, including not less than 5 invention patents; 4. Last year, the sales of patented products accounted for more than 30% of the total sales, and not less than 30 million yuan; 5. Establish an intellectual property training system, and incorporate it into the pre-job training content, and the intellectual property training rate of all employees is over 80%; 6. The investment in intellectual property work (referring to the investment in the creation, application, protection and management of intellectual property) accounts for more than 2% of the enterprise’s R&D investment; (two) to determine the intellectual property advantages of enterprises in the district, to give a one-time support of 100 thousand yuan. (3) Enterprises with intellectual property advantages in the district are valid for 3 years, and can reapply after the expiration.If the total number of valid patents and trademarks of an enterprise does not increase or does not re-apply when it expires, it will no longer be determined as an enterprise with intellectual property advantages in the district. Article 12 Standards for the management and funding of district intellectual property demonstration enterprises: (1) Enterprises that meet the following conditions at the same time may apply to the district intellectual property department, and be determined as district intellectual property demonstration enterprises after being selected on the basis of merit and submitted to the district government and management committee for approval: 1. 2. There are not less than 20 patents in the state of patent right maintenance, including not less than 10 invention patents; 3. Last year, the sales of patented products accounted for more than 30% of the total sales, and not less than 40 million yuan; 4. The investment in intellectual property work (referring to the investment in the creation, application, protection and management of intellectual property) accounts for more than 5% of the enterprise’s R&D investment; 5. The application of intellectual property strategy has achieved initial results, and it can be integrated into the overall strategy of operation and management, and it has a strong ability to seek its own development and participate in market competition by using intellectual property systems and rules. (two) to determine the district intellectual property demonstration enterprises, to give a one-time support of 200 thousand yuan. (three) the validity period of the district intellectual property demonstration enterprises is 3 years, and they can re-apply after the expiration. If the total number of valid patents and trademarks of an enterprise does not increase or does not re-apply when it expires, it will no longer be determined as a model enterprise of intellectual property rights in the district. Article 13 Support units that meet certain conditions: (1) Enterprises (units, bases, parks) with national, provincial and municipal intellectual property advantages,Give a one-time support of 300,000 yuan, 200,000 yuan and 100,000 yuan. (two) the evaluation of national, provincial and municipal intellectual property demonstration enterprises or copyright demonstration enterprises (units, bases, parks), giving a one-time support of 500 thousand yuan, 300 thousand yuan, 200 thousand yuan. Article 14 Enterprises are encouraged to make full use of patent information to carry out research and development activities. If national high-tech enterprises and demonstration enterprises with intellectual property advantages at all levels invest more than 20,000 yuan at a time to purchase their own brand patents, trademark databases, retrieval and management systems (or accounts), they will be subsidized according to 50% of the actual expenses, with a maximum subsidy of 50,000 yuan. Article 15 National high-tech enterprises, gazelle enterprises and scientific research institutions at or above the provincial level within the validity period shall have independent intellectual property management departments, newly introduce or train middle and senior intellectual property management talents, have the qualification certificate of patent agent (person) or the professional title of senior or full-senior intellectual property in Guangdong Province, and apply for not less than 20 invention patents or not less than 5 PCT international patents within one year, and shall be given a one-time support of 250,000 yuan. The time for introducing or cultivating talents shall be based on the date specified in the social security payment record or the date when the corresponding qualification certificate is issued. Sixteenth to strengthen the construction of intellectual property talents, and plan to introduce 100 intellectual property talents in five years. After selection, the newly introduced intellectual property leading talents and top-notch young talents in this district will be given a maximum housing subsidy of 2.5 million yuan and 500,000 yuan respectively according to 80% of their actual housing purchase amount in this district, which will be paid in equal amounts in five years. (1)Leading intellectual property talents participating in the selection should meet the following basic conditions: 1. The age should not exceed 50 years old; 2. Have a master’s degree or above and have a deputy senior title or above (foreigners need to prove that they have the same qualifications and abilities); 3. Have more than 15 years working experience in intellectual property rights, including more than 3 years working experience in intellectual property rights of international intellectual property organizations, world-famous enterprises or intellectual property professional service institutions, have profound theoretical knowledge of intellectual property rights, have a high level of policy theory, and are engaged in intellectual property rights work; 4. The annual income (salary income from paying individual income tax) is not less than 800,000 yuan; 5. Under the same conditions, priority will be given to national intellectual property leading talents, who have the qualification of being an associate researcher of intellectual property patents in Guangdong Province or have the qualification certificates of patents, trademarks, copyrights, laws, finance and other related practices. (2) Top-notch intellectual property young talents participating in the selection should meet the following basic conditions: 1. The age is not more than 40 years old; 2. Have a bachelor degree or above; 3. Have more than 5 years experience in intellectual property work, have good knowledge of basic intellectual property theory, policy theory level and professional practice ability, and play an important role in the intellectual property work of the unit; 4. The annual income (income from wages and salaries paid for individual income tax) shall not be less than 400,000 yuan; 5. Under the same conditions, priority will be given to talents with intermediate or above titles of intellectual property division or national intellectual property-related professional qualification certificates.During the period of enjoying the subsidy, if the property right of the purchased property changes, the relevant subsidy shall be returned. The application for housing subsidy for married talents is based on the family. If both husband and wife meet the application conditions, only one party can apply. Seventeenth to encourage enterprises to declare national, provincial and municipal intellectual property projects. For projects funded by the national, provincial and municipal intellectual property authorities, support will be given in the form of post-subsidy: (1) For national-level intellectual property projects, support will be given according to 100% standard, with a maximum of 5 million yuan; (two) the provincial intellectual property projects, according to the standard of 70% to give matching funding, up to 3 million yuan; (three) for municipal intellectual property projects, according to the standard of 50% to give matching funding, up to 1 million yuan. The supporting projects in this article shall be the industrialization projects of patents, trademarks and copyrights in Guangdong and Guangzhou, or the projects funded by the superior intellectual property department that can promote the economic development of this area. The total financial support received by the superior and the district for a single project shall not exceed the total self-raised funds of the project implementation unit, and the excess shall not be matched. chapter four
Intellectual property services Article 18 Funding for qualified intellectual property agencies: (1) A one-time grant of 100,000 yuan will be given to newly established patent agencies and their branches, which have been in operation for one year since the date of approval for establishment or filing, and enterprises in the agency area have applied for more than 30 invention patents. (2) Where the patent agency authorized 20 invention patents of enterprises in the agency area in the previous year,Sponsor 1000 yuan/piece. On this basis, if the number of authorized agency invention patents reaches 100, 300 and 500, additional subsidies will be given to 100,000 yuan, 300,000 yuan and 500,000 yuan respectively. The maximum annual subsidy for a single institution is 1 million yuan. Article 19 Institutions that encourage the introduction and cultivation of intellectual property service brands: (1) Those recognized by China National Intellectual Property Administration as national intellectual property information service centers, technology and innovation support centers (TISC) or national intellectual property information public service outlets will be given a one-time support of 500,000 yuan. (2) If the headquarters of the national intellectual property service brand organization recognized by China National Intellectual Property Administration is located in this district, it will be given a one-time support of 500,000 yuan. (3) If the headquarters of the national intellectual property service brand cultivation institution recognized by China National Intellectual Property Administration is located in this district, it will be given a one-time support of 200,000 yuan. (4) If a national intellectual property service brand organization recognized by China National Intellectual Property Administration newly establishes a wholly-owned subsidiary in this area, it will be given a one-time support of 100,000 yuan. A single brand organization only supports one subsidiary. Twentieth encourage incubator management institutions to give full play to the advantages of the platform and increase investment in intellectual property services. Give support to eligible incubators: (1) If the number of invention patents granted and the number of trademarks approved and registered in the last year are not less than 20, and there are not less than 5 new enterprises certified by the national intellectual property management system, a one-time support of 50,000 yuan will be given. (2) Encourage the establishment of an integrated intellectual property service platform,It was determined to give a one-time support of 50,000 yuan. The district intellectual property department reviews the comprehensive intellectual property service platform every year, and if it passes the annual review, it will give a one-time support of 50,000 yuan. Article 21 Give financial support to intellectual property social organizations every year: (1) Give a one-time support of 300,000 yuan to social organizations that meet the following conditions: 1. Establish and improve an internal management system, have a written management system and allocate no less than 5 full-time staff; 2. Submit the annual work summary and next year’s work plan to the competent intellectual property department or copyright department on time; 3. Hold intellectual property activities no less than 10 times a year (sponsored, co-organized, cross-industry docking exchanges, policy interpretation, knowledge training, etc. jointly organized with relevant departments), and no less than 20 enterprises participate in a single time; 4. Promote the development of member enterprises, with no less than 15 member enterprises with more than 50 annual patent and trademark applications or more than 50 copyright registrations; 5. Lead the development of the industry, and cooperate with the competent intellectual property department to complete the dynamic analysis or policy suggestion report of the industry for the reference of government departments. (2) Give a one-time support of 100,000 yuan to social organizations that meet the following conditions at the same time: 1. Establish and improve the internal management system, have a written management system and allocate no less than 2 full-time staff; 2. Submit the annual work summary and next year’s work plan to the competent intellectual property department or copyright department on time; 3 annual intellectual property activities held not less than 2 times.(sponsored, co-organized, and co-organized with relevant departments for cross-industry docking exchange, policy interpretation, knowledge training, etc.), with no less than 10 enterprises participating in one time. Twenty-second to strengthen the incubator intellectual property creation, small and micro enterprises intellectual property custody, intellectual property rights protection services. Article 23 Other situations in which special funds for intellectual property rights are used: (1) Entrusting various professional institutions to provide services such as demonstration, evaluation, auditing, law, personnel training and other related expenses for carrying out intellectual property management and related soft science research for the implementation of these Measures. (2) Funds required for implementing relevant intellectual property support policies for the implementation of the intellectual property strategy. (three) other intellectual property project expenditures approved by the district government and the administrative committee. chapter five
Supervision, management and performance evaluation Article 24 The funds required for these Measures shall be arranged by the district government and the administrative committee, and shall be included in the annual budget arrangement of the district intellectual property department and the copyright department respectively. Article 25 District intellectual property authorities and copyright authorities are responsible for the management of special funds for intellectual property rights, and their main responsibilities are as follows: (1) Responsible for compiling the budget and settlement of special funds for intellectual property rights; (two) to formulate plans for the use of special funds for intellectual property rights; (three) to do a good job in the daily management, use guidance and overall coordination of special funds for intellectual property rights; (four) responsible for the examination and approval of the application for special funds for intellectual property rights, and handling the allocation of special funds; (5) Tracking and managing projects using special funds for intellectual property rights,Grasp the implementation of the project, coordinate and solve the problems in the project implementation; (six) under the guidance of the district finance department, in accordance with the requirements of the budget performance management documents, cooperate with the performance evaluation of special funds, and check the implementation of the project and the use of special funds. (seven) other matters related to the management of special funds for intellectual property. Article 26 The district finance department is responsible for including the special funds for intellectual property rights in the budgets of the district intellectual property authorities and copyright authorities, supervising and inspecting the use of funds, and conducting performance appraisal and evaluation on the overall use of funds. Article 27 The use of special funds shall be subject to inspection and supervision by auditing, discipline inspection and supervision departments. The staff of the department in charge of special funds and the evaluation experts who violate the law and discipline in the project evaluation and fund allocation shall be dealt with in accordance with the Civil Service Law of People’s Republic of China (PRC), the Regulations on the Punishment of Civil Servants of Administrative Organs, the Interim Measures for the Investigation of Administrative Fault Liability in Guangdong Province and other laws and regulations. Supplementary provisions Article 28 If the same project and the same matter that meet the requirements of these Measures meet the requirements of these Measures or other supporting policies of this district (including the supporting policies of higher authorities and this district), support shall be given according to the principle of "from high to low", except as otherwise provided. If an enterprise applies for the same project and obtains multiple grants or support from the higher authorities, it can choose the highest grant amount in the district to apply for supporting facilities; Matching funding or support is not superimposed, but you can apply for makeup. Article 29 These Measures involve "maximum", "maximum", "above" and "not less than"The expressions "not less than", "not more than" and "full" all include this number. Thirtieth organs and institutions in the region to apply for intellectual property subsidies, funding and support, with reference to the relevant provisions of these measures. Thirty-first support funds to cash in the use of "one acceptance, internal processes, integrated services, time-limited completion" mode. The district policy fulfillment department is responsible for formal audit and follow-up supervision, and the competent business department is responsible for substantive audit. The approved application for subsidies, subsidies and support shall be allocated by the relevant departments of the district according to the procedures. The specific procedures are as follows: (1) Enterprises that meet the conditions for applying for subsidies in Items (1), (2) and (3) of Article 4 of these Measures shall report once every two months; Enterprises that meet the funding conditions in Item (4) of Article 4 of these Measures shall make centralized declaration once every quarter. Applications for domestic (including Hong Kong, Macao and Taiwan) patent grant funding should be made within 9 months after obtaining relevant certificates, applications for PCT or foreign patent grant funding should be made within 12 months after obtaining relevant supporting documents, and applications for annual fee funding for invention patents should be made within 6 months after paying annual fees. (two) enterprises that meet the conditions for applying for funding in Article 5 of these Measures shall make centralized declaration once a year. (three) enterprises that meet the conditions for applying for funding in Article 6 of these Measures shall make centralized declaration once every quarter; Applications for domestic (including Hong Kong, Macao and Taiwan) trademark funding should be made within 9 months after obtaining relevant certificates, and applications for foreign trademark funding should be made within 12 months after obtaining relevant certificates. (4)Enterprises that meet the conditions for applying for support in Article 7 of these Measures shall make centralized declaration once every quarter; The application for support related to the protection of geographical indications products shall be made within 9 months from the date of obtaining the approval announcement of China National Intellectual Property Administration, and the application for support for the license and use right of geographical indications trademarks shall be made within 9 months after obtaining the relevant supporting documents. (five) enterprises that meet the application conditions of the eighth and ninth articles of these measures shall make a centralized declaration once every quarter. The application for copyright subsidy shall be made within 6 months after obtaining the relevant certificate, and the application for funding for layout design of integrated circuits shall be made within 9 months after obtaining the relevant certificate. (six) in line with the tenth, eleventh, twelfth, thirteenth, fourteenth and fifteenth of these measures, the unit shall declare it once a year. (seven) intellectual property talents who meet the conditions of sixteenth of these measures shall be declared once a year. (eight) enterprises that meet the conditions of funding in Article 17 of these Measures shall make centralized declaration once a year. (nine) institutions that meet the funding conditions in Articles 18, 19 and 20 of these Measures shall make centralized declaration once a year. (ten) social organizations that meet the support conditions of article twenty-first of these measures shall report once a year. Units applying for support funds shall, after reaching the support conditions, make timely proposals according to the requirements of the declaration notice or service guide.Failure to apply within the time limit shall be deemed as automatic waiver. Article 33 The application for supporting funds in these Measures shall provide true and effective materials as required. In case of fraud or failure to follow the regulations on the use of funds, the fund distribution department has the right to require the supported unit to return the obtained supporting funds, publicize the violations and notify the relevant departments of the district, and will not accept the application for supporting funds from this unit within three years. If a crime is constituted, criminal responsibility shall be investigated according to law. Article 34 These Measures shall come into force as of the date of issuance and shall be valid for 5 years. During the effective period of the original Measures for the Administration of Special Funds for Intellectual Property Rights in Huangpu District of Guangzhou and Guangzhou Development Zone (Sui Pu Fu Gui [2018] No.14), matters that have been applied but have not been settled shall be settled in accordance with the provisions of the original document.
